This petition has been filed to condone the delay of 166 days in preferring the present revision.
2. The learned counsel appearing for the petitioners submitted that after receipt of summons in the suit as the first petitioner was affected by jaundice and taking treatment, he was not able to engage counsel and hence, he was set exparte and exparte decree has been passed against the petitioners. The delay is neither willful nor wanton. Hence, this Petition.
3. Despite service of notice and name printed in the cause list, none appeared for the respondents.
4. Considering the nature of the reasons assigned in the affidavit filed along with this petition and taking note of the dispute between the parties, this petition is Ordered and the delay is condoned.
