This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 31.05.2024, seeking bail in Crime No.246 of 2024 for the alleged offences punishable under Sections 147, 148, 294(b), 324, 307, 302, 506(ii) of IPC r/w 120B, 109 IPC @ 147, 148, 294(b), 324, 307, 302 (2 counts), 506(ii) of IPC r/w 120B, 109 IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence and not at all present in the place of occurrence. He further submitted that the petitioner was arrested only based on the suspicion and she has been suffering incarceration from 31.05.2024. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and hence, he prayed for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that since the petitioner/A4 had illegal relationship with the de facto complainant's husband, there was a dispute between the de facto complainant and the petitioner and due to which, on the instigation of the petitioner/A4, the other accused had murdered the de facto complainant's brother and his friend. https://www.mhc.tn.gov.in/judis

4. He further submitted that there are seven accused in this case and the petitioner is arrayed as A4. He also submitted that the investigation in this case is still pending and since the petitioner is a native of Andhra Pradesh, if she is released on bail, there is a possibility of her absconding and not available for further investigation. Hence, he opposed for allowing the petition.

5. Taking into consideration the submissions made by the learned Government Advocate (Criminal Side) that the investigation in this case is still pending and also considering the nature and gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioner.
