PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue direction to the respondents 1 to 3 to provide adequate police protection to the lives and property of the petitioner from the illegal acts of

(1) Audikesavalu and (2) Ravindran, (3) Satheesh, the respondents 4 to 6 herein and his henchmen and supporters on the basis of the complaint dated 06.05.2021.

ORDER

(This case has been heard through video conference) The petitioner seeks police protection for his property and himself against the illegal acts of respondents 4 to 6.

2. The learned Government Advocate (Criminal side) appearing for respondents 1 to 3 would submit that there is a complaint and counter complaint against each other and there is allegation of creation of forged document and on the basis of forged document, the respondents 3 to 6 attempted to trespass and usurp the property. He would also submit that what has been created by the accused can be ascertained only after hearing both the petitioner and the respondents 4 to 6. Hence, both petitioner as well as respondents 4 to 6 were called for enquiry, but both of them failed to appear. In view of the same, no specific action taken by the respondent police.

3. Considering his submissions, this Court directs the petitioner to approach the 3rd respondent police along with documents to prove his right over the property and thereafter, the respondent police, on conducting enquiry, to ascertain the fact, confirm his right, and to take appropriate action in accordance with law.

4. With the above direction, this Criminal Original Petition is disposed of.
