Respondent PRAYER: Criminal Revision Case is filed under Sections 438 & 442 of Bharatiya Nagarik Suraksha Sanhita, 2023, to call for the records of the Learned District Munsif Cum Judicial Magistrate, Cheyyur,, Chengalpattu District, set aside the order made in Crl.MP.No.76 of 2025 dated 24.02.2025 and order return of the above said vehicle in Crime No.46 of 2025 on the file of the Inspector of Police, Prohibition Enforcement Wing, Madurantakam, Chengalpattu District to the custody of the petitioner herein.

O R D E R

This Criminal Revision has been filed challenging the order dated 24.02.2025 passed in Crl.MP.No.76 of 2025 by the District Munsif Cum Judicial Magistrate, Cheyyur, Chengalpattu District, thereby dismissing the application seeking return of the property.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner owned a car bearing Registration No. PY-05-M-3448. It is alleged that the petitioner illegally transported liquor from Puducherry without any license. Consequently, the respondent police registered an FIR in Crime No. 46 of 2025 for the offences under Sections 4(1)(c), r/w 4(1)(a), 4(1-A)(ii) TNP Act. Pursuant to the registration of the FIR, the respondent Police seized the liquor along with the vehcile and produced the same before the Trial Court. The confiscation proceeding have now been initiated as against the vehicle. Therefore, the Trial Court rightly dismissed the petition seeking return of the vehicle.

4. In view of the above, this Court finds no infirmity or

illegality in the order dated 24.02.2025 passed in Crl.MP.No.76 of 2025 by the District Munsif Cum Judicial Magistrate, Cheyyur, Chengalpattu District. Accordingly, this Criminal Revision Case stands dismissed. 19.06.2025 Index : Yes/No : Yes/No Speaking/non-speaking order Lpp To
