2. Heard the submission made by the learned counsel and perused the materials available on record.

Having satisfied with the reasons stated in the affidavit filed in support of this application, this application is allowed by granting leave to the applicant to sue to file a suit for partition with respect to the Item Nos.2 and 3 of the Judges Summon mentioned property against the respondent /defendants before this Court. As a corollary, the Registry is directed to number the suit, if it is otherwise in order.
