O R D E R

The petitioner herein alleging that the police is harassing him under the guise of investigation is before this Court seeking protection from harassment.

However, on perusal of the record, this Court finds that one Usha Nandhini has given a complaint to the Chief Minister Cell and the same has been forwarded to the Deputy Superintendent of Police, Bargur. For enquiry, the petitioner was summoned to appear before Deputy Superintendent of Police on 20.06.2024, but the petitioner has not appeared for enquiry. Thereafter, the Inspector of police has again caused summon under Section 160 Cr.P.C., and Section 91 Cr.P.C., in connection with complaint No.112/21/120/121/SP/GDP/2024 and 113/8034503/CM Cell/2024 to appear on 29.06.2024 before him for enquiry. The petitioner has not appeared the enquiry. He has sent a letter to Superintendent of Police, Deputy Superintendent of Police and Inspector of Police through registered post informing that Sankar has given a false complaint against him as if the sale deed executed by 2/4

Sankar in his favour. He is not intended to convey the property, but executed only as a security for the loan availed. He has stated that without assigning C.S.R, or FIR number of current paper, he could not be summoned.

The said contention of the petitioner per se not tenable, since a preliminary enquiry as per the guideline of the Hon'ble Supreme Court in Lalithakumari case for which the petitioner been called. Without participating in the enquiry alleging that he been harassed by the police, the present petition is filed.

The contention of the petitioner is untenable. Hence this Criminal Original Petition is dismissed.
