These Original Petitions are filed to appoint a Sole Arbitrator to resolve the disputes among the parties arising out of the Development Agreement dated 15.09.2011.

2.When, these OPs are taken up for hearing, the learned counsel for the petitioner would submit that a learned Judge of this Court in O.P.Nos.277, 343, 346, 373 to 375 and 469 to 471 of 2018 by order dated 10.07.2018 has appointed former Judge of this Court Mr.A.Ramamurthi, as sole Arbitrator to adjudicate the disputes inter se the parties. The learned counsel would therefore submit that since the issues involved in those petitions were to be dealt with in the Arbitration, and the issues in the present petitions are also one and the same, the matters may be referred to the same Hon'ble Retired Judge of this Court for arbitration. It is also represented by the counsel for the petitioners that the respondent did not contest the matter as to the appointment of the Arbitrator in the earlier proceedings and even in these OP's the respondent is not contesting.

3.In view of the above submission of the learned counsel and also taking into consideration the earlier order passed by this Court dated 10.07.2018, all the Original Petitions stand ordered. https://www.mhc.tn.gov.in/judis

O.P.Nos.599 to 608 of 2020 & 62 to 66 of 2021 V.PARTHIBAN, J.

mrm i)The Hon'ble Mr.Justice A.Ramamurthi, Judge (Retd.), High Court, Madras residing at Plot No.9 (HIG), TNHB Phase II, Nolambur, Mogappair West, Chennai - 600 037, is hereby appointed as an Arbitrator to enter upon reference and adjudicate the disputes inter se the parties.

ii)The learned Arbitrator is at liberty to fix his remuneration and other incidental expenses.

iii)The proceedings may be conducted under the aegis of Madras High Court Arbitration Centre and in accordance with the Madras High Court Arbitration Rules.

iv)The parties shall bear their own costs.
