ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Section 379 IPC, in Crime No.473 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that while the respondent police was conducting the vehicle check up, the tipper lorry bearing Regn. No. TN 30 Y 3949 was intercepted and when the vehicle was searched, it was found to transport one unit of river sand without any transit permit and the Inspector of Police seized the lorry lorry along with one unit of river sand.

3. The learned counsel appearing for the petitioner submits that the petitioners did not committed any offence as alleged by the prosecution and he have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) vehemently oppose stating that the petitioners had illegally transported river sand without any valid permit.

5. Considering the facts and circumstances of the case and further the petitioner has commercially exploited the natural resources, this Court is not inclined to grant anticipatory bail to the petitioner.
