Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to grant extension of time in Crl.M.P.No. 4862 of 2019 in Crl.A. No.146 of 2016 dated 15.04.2019 and pass such furthe or other order. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.J.T.RAJA SURIYA, Advocate for M/S. MOHIDEEN PICHAI, Advocate for the Petitioner and of M/S.K.SRINIVASAN, Special public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- Earlier, this Court by an order dated 18.11.2021 directed the petitioner to produce Fixed Deposit Receipt before the Trial Court on or before 26.11.2021. Now, seeking extension of time to produce the receipt, this petition was listed today.
2. Today, when the matter taken up for hearing, Mr. J.T.Raja Suriya, learned counsel appearing for petitioner would submit that, instead of taking fixed deposit in a nationalised bank, he has taken the fixed deposit receipt in scheduled bank. Hence, the trial court is not accepting the receipt. Now, he has taken the F.D. in a nationalised bank and he is ready and willing to produce the same before the trial court. Accordingly, he seeks extension of time.
3. Considering the facts and circumstances of the case and submissions made by the learned counsel appearing for petitioner, this Court is inclined to extend the time granted earlier on 18.11.2021 to produce the fixed deposit receipt before the trial court till 17.12.2021.
4. Registry is directed to mark copy of this order to the XI Additional Special Judge (CBI Cases), Chennai. -sd/- 08/12/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
