The Criminal Miscellaneous Petition has been filed seeking to condone the delay of 43 days in preferring the appeal in Crl.A.SR.No.32230 of 2019 against the order in Crl.A.No.71 of 2018 on the file of the III Additional Session Judge, Salem.

2. Notice has been served to the respondents 1 and 2 and their names are also printed in the cause list. However, none appeared for the respondents 1 and 2.

3. The reasons stated in the accompanying affidavit filed in support of the petition are satisfied. Hence, this Court is inclined to condone the delay. Accordingly, the condone delay petition is ordered.

4. The Registry is directed to number the above Criminal Appeal, if the papers are otherwise in order.
