O R D E R

This contempt is preferred alleging that the order of the Court dated 31.03.2021 inW.P.No.8388 of 2021 is not complied. with. The order dated 31.03.2021 has only directed the Tahsildar to hold an enquiry.

2. The learned Additional Government Pleaders submits that this order has been complied with Vide the proceedings of the Tahsildar in Na.Ka.No.A1/1154/2021 dated 19.11.2021.

3. The learned counsel for the petitioner submits that while it is true that the 1/3

Tahsildar has passed the proceedings such as that, no enquiry of any sort has been conducted by the Tahsildar.

4. Refuting the same, the learned Additional Government Pleader submitted that while the Tahsildar recorded the statement, the contempt petitioner refused to sign the statement.

5. It is in this circumstances, whether any enquiry was conducted by the Tahsildar or whether the statement of the Tahsildar that the contempt petitioner refused to sign the statement given by him, involves an investigation in the question of fact which this Court considers is beyond the scope of this petition. Secondly, it is a matter of fact. It is only appropriate that the petitioner moves the concerned Revenue Divisional Officer within four weeks from today. The learned Revenue Divisional Officer is further directed to complete the enquiry as expeditiously as possible.
