Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed on the petitioner that the petitioner shall appear before th etrial court once in a month i.e on 1st working day of every month at 10.30 a.m until further order as per order in Crl.M.P.No.6418 of 2017 dated 05.05.2017 in Crl.A.No.257/2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.B.VASUDEVAN, Advocate for the petitioner and of M/S.M.PRABAVATHI GANESH RAM,ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- Heard both sides.
2.This petition has been filed seeking to relax the condition imposed by this Court, dated 05.05.2017, in Crl.M.P.No.6418 of 2017 in Crl.A.No.257 of 2017.
3.Learned counsel for the petitioner/appellant submits that the petitioner has been complying with the condition till date, that she is now in advanced stage of pregnancy, that she is having permanent residence and therefore, the condition imposed on her may be relaxed.
4.Learned Additional Public Prosecutor has no serious objection. According to the prosecution, the petitioner has been complying with the conditions regularly.
5.Considering the fact that the petitioner has been complying the condition regularly as per order of this Court dated 05.05.2017, and also the submissions made by the learned counsel for the petitioner/ appellant, this Court is inclined to relax the condition.
In the result, the condition imposed on the petitioner is totally relaxed.
