The petitioner, who was arrested and remanded to judicial custody on 22.01.2020 for the offences punishable under Sections 9-A, 22(c) and 29(1) of NDPS Act in Crime No.03 of 2020 on the file of the respondent police, seeks bail.
2. The petitioner was in possession of 65 grams of Methamphetamine. It is a commercial quantity and the petitioner failed to fulfill the twin conditions as contemplated under Section 37 of the NDPS Act. Now, so far the prosecution has examined 5 witnesses already and the matter is posted for examination of LW 6.
3. Considering the above facts and circumstances, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition is dismissed.
