This C.R.P.(P.D).No.2147 of 2021 was filed under Article 227 of Constitution of India to set aside the docket order of return of plaint dated 23.08.2021 in un-numbered O.S.SR.No.7250 of 2021 on the file of the learned District Munsif, Salem with the direction to the learned District Munsif, Salem to number the plaint. 3.

The main grounds on which this Civil Revision Petition was filed is that, petitioner purchased garments from the respondent worth Rs.1,71,654/-. Due to his business loss, he was not able to pay the amount. Respondent is trying to threaten the petitioner. Therefore, the suit was filed. The plaint was returned by the learned District Munsif, Salem, on several grounds. On considering the submission and also going through the returns, this Court gave direction to take the case on file, if cause of action is made out and the suit is not barred under any law. However, at the time of disposal, there was no direction issued to Registry to return the original plaint filed before the learned District Munsif, Salem. Therefore, this petition is under the caption for "being mentioned".
