Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records relating to the first respondent in Proceedings No.m/jp/K/vz;.1097/M1/2023 dated 27.03.2023 and quash the same by directing the first respondent to accept the appeal filed by the petitioners against the order of the second respondent after condoning the delay of 259 days. 1/4

O R D E R

This Writ Petition is filed to quash the order of the first respondent dated 27.03.2023 and consequently, direct the first respondent to accept the appeal filed by the petitioners against the order of the second respondent after condoning the delay of 259 days.

Though challenge has been made to the refusal slip issued by the first respondent, the learned counsel for the petitioners fairly submitted that if the petitioners are permitted to file an appeal, they will canvass the same before the appellate authority.

Considering the said submissions, the petitioners shall present the appeal before the first respondent within a period of two weeks from the date of receipt of a copy of this order. On such appeal being filed, the first respondent / District Registrar shall decide the same on merits and in accordance with law and pass appropriate orders, within a period of one 2/4

month thereafter. It is made clear that the appeal should be taken on file and the same shall not be rejected on the ground of limitation. 4.

With the above directions, this Writ Petition is disposed of. No costs.
