Mr.K.Raja, Standing counsel for R1 and R2 COMMON ORDER These writ petitions have been filed to direct the respondents to disburse 6% interest for belated payment of Provident Fund, Gratuity, and Earned Leave Surrender Amount within the stipulated time.
2. The brief facts which are culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioners that the petitioners was serving as Selection Grade Senior Conductor, Transport Inspector and Selection Grade Senior Driver respectively in the second respondent Corporation under the control of the first respondent Corporation and thereafter retired from service on attaining the age of superannuation. The respondents settled the Provident Fund,
Gratuity, and Earned Leave Surrender Amount with a delay. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation dated 08.05.2026 to the respondents to pay the interest at the rate of 6% p.a., for the belated payment of the petitioners Provident Fund, Gratuity, and Earned Leave Surrender Amount. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident Fund, Gratuity, and Earned Leave Surrender Amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity, and Earned Leave Surrender Amount within a period of one (1) month from the date of receipt of a copy of this order.
