ORDER

This petition has been filed seeking leave to the petitioner to file the Civil Revision Petition to confirm the auction sale held on 05.02.2020.

2. The petitioner is the auction purchaser in the Execution Petition. It is the contention of the revision petitioner that he is a third party and he was an https://www.mhc.tn.gov.in/judis

auction purchaser and he purchased the properties in Item Nos.1 to 3 on 05.02.2020. It is his further contention that before the sale being confirmed, the judgment debtor had filed an application to set aside the sale in E.A.No.33 of 2020 and the said application has been dismissed on merits on 21.12.2021. Even thereafter, the Executing Court has not confirmed the sale, despite the fact that the decree holder himself filed a memo. Hence, the auction purchaser seeks leave to file the present revision.

3. In view of the facts set out above, this Court is of the view that this is a fit case where leave has to be granted.

4. Accordingly, this Petition is Ordered and leave is granted. No costs. 18-06-2025 vrc To The Subordinate Judge, Panruti, Cuddalore District.
