ORDER
This Criminal Original Petition has been filed seeking a direction to the Principal District and Sessions Judge, Krishnagiri, to consider the petitioner's bail application sympathetically and pass orders on merits on the same day of his surrender, in connection with Cr.No. 135 of 2026, pending on the file of the respondent police.
2. Heard the learned counsel for the petitioner, and the learned Government Advocate (Crl. Side) for the respondents 1 and 2.
3. The case of the prosecution is that the de facto complainant, Sathishkumar, lodged a complaint alleging that he was informed by his sister's daughter that his father was assaulted by the petitioner for permitting cattle to graze in his field. Subsequently, the de facto complainant along with his father, sister and sister's daughter, went to the petitioner's residence and questioned the same. At that time, the petitioner attacked the de facto complainant with an aruval, causing injuries, and he took treatment at a Hospital in Hosur. The Police recorded his statement and registered an FIR in Crime No.135 of 2026 for the offence under Sections 296(b), 118(1), 351(2) BNS. Subsequently, by way of an alteration report dated 12.05.2026, Sections 3(1)(r), 3(1)(s), 3(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment
Act were also incorporated on the allegation that the petitioner had uttered caste-based abusive words against the de facto complainant.
4. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case.

In view of the above factual position, there shall be a direction to the Principal District and Sessions Judge, Krishnagiri to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with Crime No. 135 of 2026 on the file of the respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
