This Application (A. No.3844 of 2021) has been filed by the defendant seeking to receive the documents listed along with the application. The documents are 22 in number and according to the applicant / defendant by inadvertence while filing the Written Statement, the defendant did not give the list of documents and they also did not file the copies of the documents along with the Written Statement.

2. The learned counsel for the respondent / plaintiff would submit that the application can be allowed without prejudice to the rights and contentions of the respondent / plaintiff in the main suit.

3. This Court has also perused and examined the affidavit filed in support of A. No.3844 of 20201 and is satisfied with the reasons given 1/3

thereunder. Accordingly, this application (A No.3844 of 2021) is allowed as prayed for without prejudice to the rights and contentions of the respondent / plaintiff in the main suit.

4. Since the issues have already been framed and the matter is already before the learned Additional Master - II for recording evidence, this Court directs the Registry to post the matter before the very same learned Additional Master - II who has to conduct the trial. 08.11.2021 vsi2/ab 2/3
