ORDER

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 05.11.2020 for the offence punishable under Sections 273, 328 of IPC and Section 7(1), 20(2) of Cigarette and Other Tobacco Products Act, 2003, in Crime No.1437 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of banned tobacco products of 3.75 tonnes worth about Rs.22,00,000/-. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case since he happens to be known to the main accused. Hence, he prays for grant of bail.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose stating that the petitioner along with the other accused was found to involve in illicit trade of banned tobacco substances. He would submit that huge quantity of 3.75 tonnes worth about Rs.22,00,000/- was seized. He would further submit that the investigation is in initial stage.

5. Taking into account the nature of offence and that huge quantity of contraband has been seized, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
