ORDER
The instant writ petition has been filed with a prayer for issuing a Certiorarified Mandamus, to call for the entire records in pursuant to the Re-Do list issued by the second respondent dated 29.05.2025 and quash the same consequently direct the second respondent to issue the Hall ticket and permit the petitioner for the IVth semester examination optional paper in Right to Information - law & Policy scheduled to be held on 10.06.2025.
2. The case of the petitioner is that the petitioner had joined LLM Degree for the academic year 2023-2025 at Tirunelveli Government Law College and later re-allotted to the second respondent Law College. The petitioner had completed III semesters successfully. The IV semester 2/6
consists of Optional paper, Dissertation with 53 working days and the petitioner paid the exam fee on 21.05.2025 and submitted his Dissertation on 22.05.2025. But, on the last working day i.e., 29.05.2025, the second respondent had issued the Re-do list, denying the petitioner to write the exam for the shortage of attendance. Challenging the same, the petitioner has come forward with the present writ petition.
3. Learned counsel for the petitioner would submit that out of 63 days, the petitioner has attended 30 days. It is the submission of the petitioner that if the petitioner's attendance in the library is taken into consideration, he would have got sufficient attendance. Therefore, he may be permitted to write the examination.
4. Learned Government Advocate appearing for the second respondent would vehemently submits that for the total working days of 63 days, the petitioner attended only 12 days. According to the UGC guidelines, minimum attendance to participate in the examination is 75%. If at all any concession the college can give, 10% concession. Here is a case, the petitioner is far below the UGC guidelines. Therefore, he is not 3/6
entitled to write the examination.
5. Heard the learned counsel on either side and perused the materials available on record.
6. It is a settled principal of law that any guidelines of the statutory authority will have a force of statute. In the case on hand, it is a specific submission of the college that the student must have 75% attendance to participate in the examination. In this case, the petitioner had attended only 12 days out of 63 working days. Even the petitioner's affidavit do not state as to how many days he lacks. In such view of the matter, though the petitioner had paid the examination fee and also submitted his dissertation paper, this Court does not find any merit to permit him to writ exam.
7. Accordingly, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 4/6
