ORDER

This writ petition has been filed seeking for a Mandamus, directing the respondents to disburse the petitioner's revision of pay scale to the tune of Rs 43,700-69,535/- per month to the petitioner by taking note of the Honble Apex court order made in SLP (C) No 5580 of 2024 and SLP (C)No 11086 of 2024, dated 20.12.2024.

2. The learned counsel for the petitioner would submit that there was a 12(3) settlement between the Management and the employee. However, the respondents did not pay the salary according to 12(3) settlement. Hence, the petitioner seeks a prayer of mandamus to direct the respondent to pay the revision of pay scale.

The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's regularization is in issue and that they have already given a show cause notice in respect of regularization. It is the further submission of the respondent that they have paid the petitioner's salary dues upto May 2025.

4. In such view of the matter, it is apparent that there is a factual issue involves between the petitioner and the respondents and this Court cannot go into such factual issue. However, this Court deems it appropriate to direct the petitioner to give a representation, within a period of one week from the date of receipt of a copy of this order and on receipt of such representation for revised pay scale, the respondents shall consider the same and pass orders on it's own merits and in accordance with law, within a period of six(6) weeks thereafter.

5. In the result, this Writ Petition stands disposed of with the above directions. There shall be no order as to costs. 17-06-2025 kmi Index:Yes/No Speaking order Internet:Yes
