..Respondent(s) Prayer: Criminal Miscellaneous Petition filed under Section 528 of BNSS, 2023 to relax the condition imposed by this Honourable Court in para No.4(d) is that the petitioner shall appear before the Trial Court on every Tuesday at 10.30 am, until the disposal of the Criminal Revision and if he is not able to appear before

the trial court on any day he shall make arrangements to file an application under section 355 of BNSS of 2023, and shall appear before the trail court on any other day in lieu of the date of his absence, as directed by the trial court in Crl.MP.No.19283 of 2025 in Crl.A.No.1597 of 2025 dated 17.10.2025 and thus render justice.

ORDER

This Petition has been filed to relax one of the conditions imposed on the Appellant/Petitioner by this Court in Paragraph 4(d) of the Order in Crl.MP.No.19283 of 2025 in Crl.A.No.511 of 2026 dated 17.10.2025 that '' the Petitioner shall appear before the Trial Court on every Tuesday at 10.30a.m., until the disposal of the Criminal Revision and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial Court on any other day in lieu of the date of his absence as directed by the trial Court".

2.The learned Government Advocate (Crl.Side) submits that the Appellant/Petitioner has been diligently complying with the conditions imposed by this Court.

3. Considering the allegations and the nature of the offence, the condition in Paragraph No.4(d) imposed on the Petitioner/Appellant in Crl.MP.No.19283 of 2023 in Crl.O.P.No.1597 of 2026 dated 17.10.2026 is modified to the effect that " the Appellant/Petitioner shall appear before the Trial Court once in 15 days ( on working days) at 10.30 a.m., i.e., until further orders. The other conditions imposed earlier shall remain intact.

4. Accordingly, this Criminal Miscellaneous Petition is ordered. 16-06-2026 VV To
