The present Miscellaneous Petition is filed to delete the name of the 2nd respondent / Government of Tamil Nadu in the main Writ Petition, since they are not proper and necessary party in the Writ Petition.

2. A perusal of the affidavit and prayer of the Writ Petition shows that the Writ Petitioner had sought for a direction against the 1st respondent, Government of India and not against the Government of Tamil Nadu. More over, the 3rd respondent / the National Textiles Corporation Limited is under the control of Government of India. Therefore the petition is allowed.

3. Registry is directed to carry out necessary amendment in the cause title by deleting the 2nd respondent and post the main Writ Petition after three weeks.
