PRAYER: Writ Petition(Crl.) filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the Respondents 1 and 2 to reconsider the original complaint dated 07.01.2026 and the follow-up complaint dated 11.02.2026 filed by the Petitioner, conduct enquiry in accordance with law and forthwith register a First Information Report if cognizable offences are disclosed. ORDER
This Writ Petition has been filed for direction to respondents 1 & 2 to re-consider the original complaint dated 07.01.2026 and to conduct fresh enquiry in accordance with law. 2.
The petitioner lodged complaint against respondents 3 to 5 alleging several allegations before the second respondent. However, the second respondent on receipt of the said complaint, conducted enquiry and closed the complaint. The petitioner once again gave representation before the second respondent to re-consider the complaint and to conduct enquiry. The second respondent forwarded the same to District Crime Branch, Erode, pursuant to which the Inspector of Police, District Crime
Branch, Erode enquired the complaint and closed the same by the report dated 16.05.2026 for the reason all the allegations averred in the complaint are civil in nature. Therefore, the next avenue open to the petitioner is to file a private complaint in accordance with law. Therefore, the representation submitted by the petitioner to re-consider the complaint cannot be considered. However, the petitioner is at liberty to lodge a private complaint before the jurisdictional court. On receipt of the same, the learned jurisdictional Magistrate is directed to deal with the complaint in accordance with law without influence of the closure report dated 16.05.2026.

With the above direction, this writ petition is disposed of. There shall be no order as to costs.
