ORDER : The Court Made the following order :- The petitioner was arrested on 22.06.2021 for the offence punishable under Sections 109,120(B),147,148,341,294(b),302,506(ii) of I.P.C in Cr.No.201 of 2021 seek bail.

2. The case of the prosecution is that the accused and the deceased are friends and there was some misunderstanding between them. While so when the deceased was going to shop the petitioner and other accused persons brutally attacked the deceased and caused injuries on his head and neck and murdered him. Based on the complaint given by the brother of the deceased the case came to be registered.

3. The learned counsel appearing for the petitioner would submit that the petitioner had not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submits that the Court below had granted bail for the coaccused. Hence he prays for grant of bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate would submit that the petitioner along with accused joined together and murdered the deceased. Hence he vehemently opposed for grant of bail to the petitioner.

6. Taking into consideration the gravity of offence committed by the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition are dismissed. However the petitioner is granted liberty to file a petition for mandatory bail and this order will not stand on the way to pass order in the Court below.
