(Crime No.942 of 2020) PRAYER: Criminal Original Petition filed under Section 438 of Criminal Procedure Code to enlarge the petitioner on bail in the event of her arrest in Crime No.942 of 2020 on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offence publishable under Sections 4(1) (aaa), 4(1-A) of TNP Act 2000, 6 & 11 of TN Rectified Spirit Rules Act, 2000 in Crime No.942 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 840 liters of Rectified Spirit. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and she has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner along with other accused was found in possession of 840 liters of Rectified Spirit. He would further submit that there are ten previous cases against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

Hence, he would vehemently oppose for the grant of anticipatory bail to the petitioner.

5. Taking into consideration the nature of offence and the fact that there are ten previous cases against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
