C.M.P.No.15369 of 2022 in C.M.A.SR.No.22946 of 2020 N.MALA,J, This Petition has been filed to condone the delay of 1019 days in filing the above Civil Miscellaneous Appeal.

2.Mr.P.M.Jayachandran, the learned counsel appears for the first respondent. The respondent Nos. 2 and 3 (Minors) are represented by the first respondent. As far as 5th respondent is concerned, he remained ex-parte in the Court below and the learned counsel also made an endorsement, that notice to R.5 may be dispensed with. 3.The 4th respondent, being the mother of the deceased, died during the pendency of the appeal and the learned counsel further submits that respondent Nos.1, 2 & 3 are the legal heirs of the 4th respondent.

4.The contesting first respondent has no serious objection for the delay of 1019 days being condoned.

5.In view of the above submission, the delay of 1019 days is condoned and this C.M.P. is ordered.

6. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same "for admission" in usual course. 7.Registry is further directed to print the name of the counsel for the first respondent at the time of admission.
