No. 14877 of 2023 in C.M.A. No. SR86704 of 2023 SUNDER MOHAN, J This petition has been filed to condone the delay of 225 days in filing the above appeal. 2.The first respondent remained ex-parte before the Tribunal and the learned counsel for the petitioner / appellant seeks permission of this Court to dispense with the notice to the first respondent. Hence, notice to the first respondent is dispensed with.
3.Though notice has been served on the second respondent and his name has been printed in the cause list, none has entered appearance on behalf of him.
4.Being satisfied with the reasons stated in the affidavit filed in support of this petition, the delay is condoned on condition that the petitioner / appellant shall forfeit the interest for the delay period in the event of this Court enhancing the compensation.
5.Accordingly, this Petition is ordered.
