CMP.No. 16984 of 2021 in AS.SR.No.85059 of 2020 R.N.MANJULA, J., The petitioner is the appellant, who filed a suit in O.S.No.49/2013 before the District Court, Karaikal, for the relief of partition and separate portion of 5/24 share in the suit property and the same was dismissed. Challenging the said judgement the appellant has filed an Appeal in AS.No.120 of 2022. Pending the Appeal, the petitioner/appellant has filed this petition to register her relinquishment of right as against the 4th defendant namely V.Noel. It is submitted that the relinquishment is sought, because of a prior settlement made between herself and the purchaser of the 4th respondent by name Samudrakani.

The learned counsel for the respondents also has no objection to relinquish the right claimed by the petitioner/appellant as against the 4th respondent/defendant.

In view of the same the Civil Miscellaneous petition is disposed of and the relinquishment right as against the 4th respondent is recorded and consequently 4th respondent is exonerated.
