This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 along with relevant Rules of the Original Side of Madras High Court seeking Succession Certificate relating to the debts in the name of Mr.M.Sivakumar, the brother of the petitioners herein. Mr.M.Sivakumar died intestate on 17.07.2021. He was working as a Supervisor in Apollo Hospitals. In the schedule to the petition, it had been stated that an amount of Rs.3/- Lakhs is to be received towards Employee Insurance claim.
2.After following due procedure, the petitioners were directed to tender evidence. Accordingly, the 1st petitioner, M.Karpagam, examined herself as PW-1. The death certificate of her brother, M.Sivakumar, was marked as Ex.P1. Her parents also died and she marked the death certificates of her mother and father as Exs.P2 and P3. The documents from the Apollo Hospital and the certificate filed under Section 65B of the Indian Evidence Act were marked as Exs.P4, P5, P6 and P7.

smv 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued jointly in favour of the petitioners in accordance with the rules.
