ORDER

This Criminal Revision has been filed as against the order passed by the learned Judicial Magistrate, Vandavasi, Tiruvannamalai District in Crl.M.P.No.672/2025 in Cr.No.31/2025 dated 16.05.2025, thereby dismissed the application to return the property.

2. Heard both sides and perused the materials available on record.

3. The petitioner is an accused in the case registered in Cr.No.31/2025 for the offences punishable under Section 4(1)(A), 4(1)(C) of TNP Amendment Act, 2024. The petitioner is the owner of the Vehicle viz., Maruti Eco Star Car bearing Reg.No.TN23 DA 332. On 06.04.2025, the petitioner had illegally transported four liquor bottles in his vehicle. In pursuance of registration of FIR, the petitioner's vehicle was seized and deposited before the trial Court. Hence, the petitioner had filed a petition to return the property before the trial Court and the same was dismissed on the ground that the respondent had initiated confiscation proceedings to confiscate the vehicle. Aggrieved by the same, the present revision has been filed.

4. Since the confiscation proceedings are pending, this Court is not inclined to allow this revision.
