ORDER
This Criminal Original Petition has been filed by the petitioner for transfer of investigation of the case in Crime No.136 of 2025 on the file of the third respondent to some other competent authority for speedy investigation.

The case of the petitioner is that due to political enmity, on 27.04.2025 at about 9.15 p.m., the fourth respondent along with three other accused, attacked the petitioner with stone and also threatened him with dire consequences, due to which, the petitioner sustained injuries in his right knee. Immediately, he was given first aid in the Velur Government Hospital and thereafter, admitted in the Namakkal Government Hospital during which, based on the complaint given by the petitioner, the third respondent Police registered the case in FIR No.136 of 2025 against the fourth respondent. 2/6

The contention of the petitioner is that after taking treatment in the Namakkal Government Hospital, the petitioner was transferred to Ganga Hospital, Coimbatore, wherein surgical treatment was performed and that the petitioner was admitted as an inpatient from 30.04.2025 to 24.05.2025. Meanwhile, the fourth respondent had filed a petition for anticipatory bail before this Court in Crl.O.P.No.14492 of 2025 and when the said matter came up before this Court on 08.05.2025, the third respondent police, under the influence of the fourth respondent, misled this Court stating that the petitioner had already been discharged from the hospital and therefore, this Court granted anticipatory bail to the fourth respondent.
Despite the grievous nature of the assault and supporting medical evidence, the third respondent police failed to take any effective investigative steps and colluding with the fourth respondent to weaken the case. After registration of FIR, no investigation was done and the other accused have not been secured.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents 1 to 3 and also perused the materials available on record.
5. Since no adverse order is being passed against the fourth respondent, notice to the fourth respondent is dispensed with.
6. Admittedly the petitioner was earlier treated as inpatient in the Government Hospital, Namakkal and subsequently discharged on 28.04.2025. Thereafter, he was admitted in a private Hospital, Coimbatore for treatment, but the same was not intimated before this Court while considering the bail petition of the fourth respondent during vacation Court. However, that cannot be a sole ground for transfer of investigation unless the malafide intention is proved.
7. Therefore, this Criminal Original Petition is dismissed. 4/6
8. However, the respondent police is directed to conduct a fair investigation and file the charge sheet.
