Writ petition filed under Article 226 of the Constitution of India praying to issue a writ of Mandamus directing the respondents 1 to 4 to remove the encroachment made in the cart track in S.No.141/1B and 141/2B situate at S.Ponnapuram Village by the 5th and 6th respondents on considering the petitioner's representation dated 17.02.2024 and 18.05.2024 and issue direction to eviction of encroachment in cart track. (Order of the Court was made by M.Sundar, J.) In representation dated 18.05.2024 made by the writ petitioner, there is a reference to atleast two different orders of this Hon'ble High Court but the same are not before us.

Faced with the above situation, Mr.A.Kumar, learned counsel on record for writ petitioner sought leave of this Court to withdraw the captioned 'Writ Petition' {hereinafter 'WP' for the sake of brevity} but made a plea to preserve all rights and contentions of the writ petitioner to come up with same / similar prayer on the same cause of action and / or any other suitable prayer after annexing the orders referred to in the aforementioned representation. This request is acceded to. 2/4

In the light of the narrative thus far, captioned WP is disposed of as closed / withdraw albeit with preservation of all rights and contentions of writ petitioner to come back to this Court with same / similar prayer and / or any other suitable prayer on the same cause of action.
