PRAYER: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of Writ of Mandamus to direct the 2 nd respondent to conduct an enquiry an to cancel the settlement deed vide Doc.No.9888 of 2015 dated 14.10.2015 registered in the 3 rd respondent office executed by the petitioner in favour of fourth respondent in respect of property to an extent of 23 cents comprised Survey No.17/11 situated at Thodukadu Namachivayapuram Village, Sriperambadur Sub Madhura, Namachivayapuram Registrar District, Thriuvallur District based on petitioner's representation cum petition dated 24.10.2024. For Petitioner : Mr.M.Saravana Kumar For Respondents : Mr.R.Murthi, GA for R1 to R3.
O R D E R
The petitioner is a senior citizen, the petitioner is having one son and one daughter. The property in S.No.17/1, Kancheepuram District, measuring 68 cents, was inherited by petitioner's husband. Out of the 68 cents, the petitioner's husband settled an extent of 23 cents, in favour of the petitioner, under a registered settlement deed executed on 16.12.2010. On the basis of a Page No.2 of 5
promise given by the petitioner's daughter/4 th respondent herein, that she woud take care of the petitioner, the petitioner executed a settlement deed on 14.10.2015, in favour of the 4 th respondent. However, the 4 th respondent failed to maintain the petitioner and her husband. Hence, the petitioner submitted a representation on 22.08.2024, to the second respondent and as no action was taken, the petitioner was constrained to file the present writ petition.
2. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents 1 to 3, and perused the materials available on record. With consent of both counsels, this writ petition is taken up for final disposal.
3. Under the above facts and circumstances of the case, I am inclined to direct the second respondent to consider the petitioner's representation dated 24.10.2024 and pass orders on merits and in accordance with law, within a Page No.3 of 5
period of eight weeks, from the date of receipt of a copy of this order. It is needless to state that the second respondent shall conduct enquiry as per the provisions of the Senior citizen Act, by giving adequate opportunity of hearing, to the petitioner as well as to the 4 th respondent.
