ORDER

The relief sought for in this writ petition is to direct the second respondent to survey with the assistance of the third respondent to survey and fix the boundaries for the land bearing Plot Nos.21 and 22 measuring about 2400 Square Feet, comprised in Town Survey No.2/1, Re-Survey No.178/1, Ward-N, Block No.1, Cadaster Nos.789 1/2 1/2, 789 2/2 790, 791, Patta No.93, situated in No.44, Murugampakkam Village, Muthaliyarpet Commune, Puducherry, as per Tamil Nadu Survey and Boundaries Act, 1923.

takes notice on behalf of the respondents. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the petitioner has purchased a property bearing Plot Nos.21 and 22 measuring about 2400 Square Feet, comprised in Town Survey No.2/1, Re-Survey No.178/1, Ward-N, Block No.1, Cadaster Nos.789 1⁄2 1⁄2, 789 2/2 790, 791, Patta No.93, situated in No.44, Murungampakkam Village, MuthaliarpetComunion, Puducherry from one Thillagarasa and Mrs.IndiraThillagarasa. This being so, the petitioner filed an application through online dated 29.06.2024 for the purpose of conducting survey and mark the boundaries along with requisite fee for the aforesaid property. However, no steps were taken. Hence, the petitioner has sent a representation dated 30.12.2024 to the respondents to survey and mark the boundaries of the said property. However, till date, the said representation was not considered. Hence, the petitioner has come forward with the present writ petition. 3/6

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the second respondent to consider the petitioner's online application dated 29.06.2024 to survey and mark the boundaries.

5. Learned Government Advocate appearing for the respondents submitted that the petitioner's online application dated 29.06.2024 would be considered and orders passed within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the limited relief sought for by the learned counsel for the petitioner, this Court directs the respondents 2 & 3 to survey and fix the boundaries in respect of aforesaid petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as 4/6

well as aggrieved persons, if any, within a period of four weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the revenue authorities is at liberty to approach the Police officials, in which case, the Police officials shall render assistance to the revenue authorities to carry out the aforesaid exercise.

8. With the aforesaid direction, this writ petition is disposed of. No costs.
