Prayer: The miscellaneous petition is filed U/s.528 of BNSS Act, 2023, to permit the petitioner to withdraw the deposited conditional amount of Rs.4,00,000/- (Four Lakhs) in Crl.R.C.No.944 of 2016 dated 13.02.2020 on the file of this Court.

ORDER

The learned counsel for the petitioners / respondents in Crl.R.C.No.944 of 2016 submits that both sides have compromised the matter and the compromise memo has already been filed, by which the deceased respondent / complainant before the trial Court is permitted to withdraw the amount deposited by the revision petitioner / accused. 2.Both the parties have passed away and their legal heirs were now brought on record.

3.Now the legal heirs of the deceased respondent have entered appearance through Mr.L.Ramanathan. The learned counsel would now make a 2/5

statement on instruction that he has no objection to let the petitioner's legal heirs withdraw the sum which is partly deposited before the trial Court and partly before this Court.

4.The above Criminal Miscellaneous Petition stands disposed of accordingly.
