Crl.O.P.No. 15682 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Raja @ Rajasekaran @ Aandiyampalaiyamraja, who was arrested and remanded to judicial custody on 26.06.2023 for the offences punishable under Sections 4(1)(A), 4(1)(a) of T.N.P Act in Crime No.268 of 2021 on the file of the respondent police seeks bail.

The learned Senior counsel for the petitioner submitted that, petitioner had already granted anticipatory bail by this Court on 24.05.2023 in Crl.O.P.No.11487 of 2023, but he had not complied with the conditions imposed in the order. Therefore, he was arrested and remanded to Judicial Custody on 26.06.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Government Advocate (Crl. Side) submitted that, petitioner was found in possession of 40 litres of illicit ID arrack on 04.06.2021 at about 14.00 hrs. He further submitted that, 1/3

apart from this case, there are 29 previous cases pending against the petitioner. Out of which, he was granted anticipatory bail in 12 cases. In those cases, he neither surrendered nor complied with the condition. In other cases, pending for trial, he is not co-operating with the trial proceedings by repeatedly filing petition under Section 317 of Cr.P.C., Hence, he vehemently opposed for grant of bail to the petitioner.

4. In the light of the submission of the learned Government Advocate (Crl. Side) that there are series of cases pending against the petitioner and his non-cooperation of Court proceedings by repeatedly filing petition under Section 317 of Cr.P.C., and non-compliance of the anticipatory bail conditions granted in favour of the petitioner, this Court is not inclined to grant bail to the petitioner. 5.Accordingly, this Criminal Original Petition is dismissed. 17.07.2023 Sma 2/3
