ORDER
This Writ Petition has been filed seeking to quash the confiscation order passed in Na.Ka.No.61/KU.KA.KA/ THA/VEY-MA/2026 dated 25.05.2026 by the 1st respondent in respect of Suzuki Access Motor Cycle bearing Registration No.TN-23-DW-4440 seized in Crime No.52 of 2026 and consequently to direct the respondents to release the said vehicle to the petitioner
2. It is the case of the petitioner that in respect of crime No.52 of 2026 on the file of the second respondent, the aforementioned petitioner's vehicle was seized. Though the petitioner submitted explanation in this regard, the first respondent passed the impugned order confiscating the said vehicle. Hence, the present writ petition has been filed before this Court.
3. Learned counsel for the petitioner submitted that the petitioner, without prejudice to his rights and contentions, is ready to deposit a sum
of Rs.1,00,000/- (Rupees One Lakh only) before the first respondent and on such deposit being made, the first respondent may be directed to release the vehicle.
4. On the above said contentions, heard the learned Counsel for Government of Tamil Nadu appearing for the respondents and perused the materials placed on record.
5. Admittedly, the Petitioner's vehicle was seized in connection the aforementioned crime No.52 of 2026 on the file of the second respondent. Keeping the vehicle idle will no longer serve any purpose. Hence, the impugned order is quashed. Consequently, this Court issues a direction to the Respondents to release the Petitioner's vehicle namely, Suzuki Access Motor Cycle bearing Registration No.TN-23-DW-4440 subject to the following conditions:
(i) The Petitioner, without prejudice to his rights and contentions, shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh only) before the first respondent within a period of two weeks from the date of receipt of a copy of this order;
(ii) The Petitioner shall appear in person and produce all the relevant documents proving the ownership of the vehicle for verification
by the Authority;
(iii) On being satisfied with the ownership of the vehicle and on receipt of payment as stated supra, the first respondent shall release the subject vehicle, within a period of one week from the date of deposit; (iv) The Petitioner shall not use the said vehicle for any unlawful purpose and shall not alienate the same during the pendency of the proceedings;
6. The Writ Petition is disposed of accordingly. Consequently, connected miscellaneous petition is closed. No costs. 05.06.2026 Index : Yes/No : Yes/No Speaking/non-speaking order lok
