ORDER
This petition has been filed seeking a direction to the respondent to consider the petitioners application dated 17.11.2025 in File No.XURBY1DI/
2025 /TCP and Consequently pass appropriate orders on the petitioners applications seeking technical clearance and approval for formation of a residential layout, within a time frame to be stipulated by this Honble court.
2. It is the case of the petitioner that she has applied for technical clearance and approval of a residential layout on 19.07.2025. The petitioner claims ownership of the land in S.Nos.158/2B3 and 158/2B4 at North Avinashipalayam Village, palladam Taluk, Tiruppur District based on a compromise decree and subsequent settlement/release deeds. The application was submitted to develop the property into a residential layout and generate income. The respondent has issued a return letter dated 27.07.2025, raising an objection regarding a common pathway measuring 0.83 acres, apparently based on a notice from the petitioner's sister. The petitioner submitted a detailed reply on 17.11.2025 stating that the common pathway would remain available for common use and providing supporting documents. However, the authority has neither approved nor rejected the application and has not communicated any further defects. Hence, the petitioner filed the present writ petition before this Court.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.
4. The learned Government Counsel appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the second respondent respondent to consider and pass orders on the petitioner's representation dated 17.11..2025 within a period of six weeks from the date of receipt of a copy of this order.
