It is submitted by the learned counsel appearing for the petitioner that this Petition was filed by the petitioner/accused, challenging the order, dated 25.11.2009, passed by the learned Judicial Magistrate No.II, Erode, in Crl.M.P.No.7157 of 2009, in C.C.No.270 of 2004. The learned counsel also submitted that the complainant, viz., the respondent herein died and C.C.No.270 of 2004, was also closed. The learned counsel, therefore, submitted that the Petition has become infructuous.
