This case came up for settlement before the National Lok Adalat. Both the parties are present. The learned counsel for the appellant Mr.E.Rajadurai for M/s.M.B.Gopalan Associates and Mr.K.Naveen Kumar, learned counsel for the 1st and 2nd respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT Both the parties and their respective counsel are present.
2. The Tribunal has awarded a sum of Rs.13,90,000/(Rupees Thirteen Lakhs Ninety Thousand only) with interest at 7.5% p.a. from the date of petition till the date of deposit as compensation.
3. Aggrieved by the award, the appellant has preferred the present appeal. Now the appellant has agreed to deposit a sum of Rs.17,50,000/- (Rupees Seventeen Lakhs Fifty Thousand only) in full quit, which is also acceptable by the respondents 1 and 2/claimants .
4. The respondents 1 to 2 are permitted to withdraw their shares without filing any formal petition. Since, the 2nd respondent has attained the age of majority as evident by the xerox copy of Aadhar Card produced by her, wherein his date of birth is mentioned as 20.10.2002, she is permitted to withdraw her 50% share amount and the 1st respondent is also permited to withdraw her 50% share amount.
5. The appellant is directed to deposit the award amount, now ordered after deducting any amount already deposited, within a period of eight weeks from the date of receipt of a copy of this order. Award is passed accordingly.
6. The Tribunal is directed to issue the award amount through NEFT/RTGS to the party concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition.
7.The appeal is ordered accordingly. Consequently, the connected MP, if any, is closed.
