The petitioner is the first accused in Crime No.25/2009 on the file of the first respondent police for offence under Sections 120(b), 420 I.P.C. Seeking to quash the said case, the petitioner is before this Court with this petition.
2. I have heard the learned counsel for the petitioner; the learned Additional Public Prosecutor appearing for the first respondent; the learned counsel appearing for the second respondent and I have also perused the records carefully. 3.When this matter came up for hearing, the learned Government Advocate (crl.side) appearing for the first https://hcservices.ecourts.gov.in/hcservices/
respondent submitted that the investigation has been completed and the case has been referred to as "mistake of fact" and the negative report has also been filed before the learned Judicial Magistrate concerned.
4.In such view of the matter, nothing survives in this petition and accordingly, the Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
