The petitioner, who was arrested and remanded to judicial custody on 28.06.2022 for the offences punishable under Sections 354(B), 354(D) IPC r/w Section 4 of POCSO Act 2012 in Crime No.16 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that petitioner had kidnapped the victim girl and committed penetrative sexual assault on the victim girl. Hence, the complaint.
3. On perusal of the statement recorded under Section 164 of Cr.P.C. revealed that the victim girl was kidnapped by the petitioner. Thereafter, he threatened her and under compulsion, after closing the victim's mouth with cloth, he had committed penetrative sexual assault on the victim girl. Due to which, the victim girl sustained grievous injuries on her private part. Thereafter, 7 stitches was put up by the Doctor.
4. Therefore, the petitioner have committed very serious and heinous offence as against the minor victim girl and this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original petition is dismissed.
