Crl.O.P.No.15764 of 2023 G.CHANDRASEKHARAN.J., The petitioners namely Ashok Kumar, Yuvaraj and Arunraj, who apprehend arrest at the hands of the respondent police for the offence under Sections 420 and 506(i) of IPC in Crime No.182 of 2023 on the file of the respondent seeks anticipatory bail. 2.The learned counsel for the petitioner submitted that, petitioner is an innocent and he has been falsely implicated in this case. He further submitted that, even as per the FIR allegations, no overt act is attributed against the petitioner. Apprehending arrest, this petition is filed.

3. In response, learned Government Advocate (Crl. Side) submitted that, accused in connivance with each other had received a sum of Rs.13,55,000/- from the defacto complainant on various dates and on various modes, on the pretext of securing job at Railway Department. However, they neither secured job nor returned the money. 1/3

It is alleged in the FIR that, 1st accused namely Ashok Kumar informed the defacto complainant that, his brother-in-law is working in Eastern Railways Department and through him, he would get employment to the defacto complainant. He also shown appointment order in favour of one Yuvaraj in Eastern Railway Department. Believing his statement as true, defacto complainant paid an amount of Rs.13,55,000/- to Yuvaraj and his friend Jeraldu Rubhan and also to the account of Arun Raj on various dates. The details of payment is given in the FIR. Accused neither secured job nor returned the money.

5. Considering the gravity of the offence alleged to have been committed by the accused and so far the amount is not recovered and that investigation is not completed, this Court is not inclined to grant anticipatory bail to the petitioner.
