ORDER

The petitioner, who was arrested on 05.01.2025 for the offences punishable under Sections 103(2) of BNS Act, 2023( Section 302 of IPC) in Crime No.12 of 2025 seeks bail stating that the respondent has completed the investigation and filed final report.

2. Earlier, when the matter was taken up for consideration on 08.08.2025, this Court, taking note of the fact that the matter is posted for committal on 19.08.2025, adjourned the matter today to ensure that the matter is committed to the Court of Sessions.

3. Today, the learned Government Advocate (Crl.side) for the respondent police states that the case is not yet committed and posted on 05.09.2025 since two of the accused were arrested in another case, they could not be produced.

4. Heard both sides and perused the materials available on record.

5. Considering the above facts and circumstances of the case, submissions made by learned counsel on either side, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate-I, Ambattur and on further conditions that : [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy Page No.2/5

of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the concerned Judicial Magistrate Court on every Monday at 10.30am till the completion of the committal proceedings.

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 25.08.2025 nr Page No.3/5
