Respondents Prayer: This Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondents 2 and 3 to consider the petitioner representation dated 04.11.2020 and issue the patta in the petitioner name in respect of the Natham land in S.F.No.577/7 situated at Sembagounden Pudur, Kuppepalayam village. ORDER

This Writ Petition has been filed for the issue of Writ of Mandamus directing the second and third respondents to act upon the representation made by the petitioner on 04.11.2020, wherein the petitioner has sought for patta in his name with respect to the subject property.

2.Mr.E.Bala Murugan, learned Special Government Pleader appearing on behalf of the respondents submitted that as on today, the patta stands in the name of one Subbiah Gounder. The learned counsel further submitted that the third respondent has called the parties for preliminary enquiry on 22.12.2020 at 11.00 A.M. The learned counsel further submitted that the third respondent will conduct preliminary enquiry and will send a report to the second respondent and thereafter, the second respondent will pass orders in accordance with law. 3.

Taking into consideration the facts and circumstances of the case and also of the fact that the third respondent has already called the parties for preliminary enquiry, there shall be a direction to the third respondent to conduct the preliminary enquiry after giving opportunity to the petitioner and also the aforesaid Subbiah Gounder and a report shall be submitted before the second respondent within a period of six weeks from the date of receipt of a copy of this order. The second respondent on receipt of the report shall pass final orders strictly in accordance with law within a period of four weeks thereafter.

4.This Writ Petition is disposed of with the above directions. No costs.
