Order : This petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.SRINATH SRIDEVAN, Advocate for the petitioner and of MR.R.KRISHNASAMY, ADVOCATE for the 3 to 7 Respondents, the court made the following order:- This petition is filed to condone the delay of 1331 days in filing the petition to set aside the abatement caused due to the death of the first respondent in the above first appeal.
2. Heard both sides.
3.Being satisfied with the reasons stated in the affidavit filed in support of this petition, this petition is allowed and the delay is condoned on condition that the petitioner shall pay a sum of Rs.2,000/- [Rupees Two Thousand Only) to the Cancer Institute (WIA), No.38, Sardar Patel Road, Adyar, Chennai - 600 036, on or before 08.12.2021, failing which, the petition shall stand dismissed automatically without any further reference to this Court.
4. Post the matter on 09.12.2021.
