ORDER
The petitioner, who apprehends arrest pursuant to issuance of Non Bailable Warrant by the Judicial Magistrate-1, Chengam, Tiruvannamalai in PRC.No.14 of 1997, seeks anticipatory bail.
2. According to the learned counsel for the petitioner, the petitioner has not committed any offence as alleged by the prosecution.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the respondent/Police registered a case as against the petitioner in Crime No.370 of 1994 and the same is pending in PRC No.14 of 1997, before the learned Judicial Magistrate-1, Chengam, Tiruvannamalai. Hence, he opposed to grant anticipatory bail to the petitioner.
4. I have given my anxious consideration to either side submissions and perused the materials available on record.
5.Considering the rival submissions of both sides, this Court is of the view that it is not desirable to grant anticipatory bail as against the non-bailable warrant issued by the Court for the absence of the accused. However, the petitioner is at liberty to approach Judicial Magistrate-1, Chengam, Thiruvannamalai District and on surrender, seek recall of the warrant by filing proper application before the said Court. On such application being filed by the petitioner, the learned Judge shall consider and dispose of the same on merits and in accordance with law on the very same day uninfluenced by any observations made in this order.

With the above directions, this Criminal Original Petition is dismissed.
