ORDER

This Criminal Revision Case has been filed against the Judgment dated 01.07.2022 passed in C.A.No.05 of 2020 on the file of the Principal District and

Sessions Judge, Ariyalur, thereby confirming the order of conviction and sentence imposed in STC No.220 of 2016 dated 23.09.2020 on the file of the Judicial Magistrate No.II, Ariyalur, for the offence punishable under Section 138 of the Negotiable Instruments Act.

The learned counsel appearing for the petitioner would submit that pending revision, the petitioner and the respondent have amicably settled the issue and the petitioner has paid the entire cheque amount to the respondent.

3. The learned counsel for the respondent also concedes with the submission made by the learned counsel for the petitioner and the respondent has no objection to set aside the conviction and sentence imposed on the petitioner herein, since the respondent had received the entire cheque amount.

4. In view of the above submissions made by the learned counsel appearing on either side and in the light of the settlement arrived at between the parties, this Court is inclined to set aside the order of conviction and sentence imposed on the petitioner.

Accordingly, the conviction and sentence imposed on the petitioner in STC No.220 of 2016 dated 23.09.2020 on the file of the Judicial Magistrate No.II, Ariyalur, as well as the Judgment dated 01.07.2022 passed in C.A.No.05 of 2020 on the file of the Principal District and Sessions Judge, Ariyalur are hereby set aside and the Criminal Revision Case stands allowed. Consequently, connected miscellaneous petition is closed.
